Council’s ‘zero tolerance’ approach on two flytippers sends out ‘strong message’

Two men who pleaded guilty to dumping household rubbish at a recycling site have been find more than £1,000 each.

Daniel O’Connor and Claude Tambwe, both of Lomond Road, Hemel Hempstead, pleaded guilty to leaving waste at a recycling site and failing to comply with Sections 33 and 34 of the Environmental Protection Act 1990.

On separate occasions in January, both men were caught on CCTV dumping the waste at the recycling site in Henry Wells Square, Hemel Hempstead.

When interviewed by Dacorum Borough Council’s enforcement officers, both men admitted to dumping the waste and pleaded guilty at St Albans Magistrates Court on Wednesday, April 8.

They pleaded guilty to knowingly causing or permitting controlled waste to be deposited in or on land, not in accordance with a waste management licence.

Mr O’Connor was ordered to pay a total of £1,455.71 and Mr Tambwe a total of £1,434.26.

Nicholas Egerton, team leader in Regulatory Services, Environmental Protection and Housing at the council, said: “We hope these prosecutions send out a strong message about Dacorum Borough Council’s zero tolerance approach to fly tipping.

“Fly tipping spoils the environment and the cost of clearance wastes valuable resources.

“The small number of people who dump their waste rather than using the bins provided are leaving the sites looking untidy, inviting others to dump their rubbish too.

“The 17 sites across the Borough are provided for residents and members of the public to dispose of permitted recyclables only.

“If you spot any flytipping, please report it to us on our website.”

Dacorum Borough Council’s Environmental Enforcement Team monitor these sites and will continue to take action against future offenders. Signs were put up at the sites in December last year.

Flytipping is a criminal offence. Offenders who dump waste at the sites could be issued with a Fixed Penalty Notice of £75 or be prosecuted for flytipping which is a criminal offence under The Environmental Protection Act 1990.
